Adverting to your letter 18th September
1906, 33409/1906, on the subject of the amount to be
credited to the War Department in the Colonial Military
lands account in respect of the land near Murray
Battery and Stanley Cantonment at Hong Kong, I am
commanded to acquaint you, for the information of the
Earl of Elgin, that the Army Council are unable to
acquiesce in the opinion of Sir Henry Berkeley dated
7th August 1906, on the wording of paragraphs 4 and 6 of
Lord Ripon's Circular of 30th December 1894.
2. Sir H.Berkeley's opinion appears to be
based on a misconception of the words "the proceeds of
the sale" which he appears to think should be restricted
to the premiums paid to Government for the Crown lease
of the lands the leasehold interest in which has been
sold. The Army Council are unable to accept this
interpretation of the Circulars for the reason that
only a portion of the interest of the Colonial Government
is sold to realise these premiums, the remaining interest
